Agreement to these terms

By using this website you agree to these terms. If you do not agree with them, please do not use the site. If you use the site on behalf of a company or another person, you are confirming that you have authority to accept these terms for them.

These terms apply to the website only. If you become a tenant, your rights and obligations as a tenant are governed by your signed lease, and nothing here changes it.

Who we are

Smith Center is a two-building commercial property at 3935 and 3937 Sunset Blvd, West Columbia, SC 29169. The property is owned by kdhenu LLC and managed by Fod Mgmt LLC. In these terms, “we,” “us” and “our” mean those entities, and “you” means the person using the site.

What this site is for

This site exists to show what is available for rent at Smith Center — suite sizes, photographs, floor plans, walkthrough videos, amenities and asking rents — and to give you a way to reach us about them. It is marketing and general information. It is not legal, financial, tax or real estate advice, and you should not treat it as a substitute for visiting the property or reading a lease.

Listings, availability and pricing

We try to keep the site accurate and current, but leasing moves faster than a website does. Everything shown here is subject to change or withdrawal without notice, including:

• Availability. A suite shown as available may already be leased, under a signed letter of intent, or held for another prospect.
• Rent and terms. Rents, deposits, escalations, concessions and lease lengths are asking figures and starting points for discussion, not fixed prices.
• Square footage and dimensions. Areas, measurements and floor plans are approximate, come from earlier drawings and records, and are given for general reference. They have not been re-measured for this site. Verify anything you intend to rely on.
• Photographs and videos. Images show the property at the time they were taken. Finishes, furnishings, signage and neighbouring tenants change.
• Amenities and utilities. What is included with a given suite is determined by that suite's lease, not by this site.

No lease, offer or reservation

Nothing on this site is an offer to lease, and nothing you do on this site creates a lease or reserves a suite. Submitting the inquiry form, calling, texting, emailing, touring the property or receiving a proposal from us does not give you any right to occupy space.

A tenancy is created only by a written lease signed by both you and the landlord. Until that happens, either of us can walk away for any reason, and we may lease any suite to anyone else at any time.

Inquiries and how we reply

When you send an inquiry through the form, or call, text or email us, you are asking us to get back to you — so you agree that we may respond by phone call, text message or email at the contact details you gave, about the space you asked about and about availability at the property. Standard message and data rates from your carrier may apply. You can ask us to stop contacting you at any time and we will.

Please give accurate information, and please do not send confidential, sensitive or privileged material through the form. It is a simple web form and email pipeline, not a secure channel. What happens to the information you send is described in our Privacy Policy.

Applications and outside services

Rental applications, current listings and any online payments are handled on TenantCloud, which is an independent service with its own terms and privacy policy. Some suites are also listed on LoopNet. When you leave this site for one of those services, you are dealing with that company, under their rules, and we do not control what they do with your information or how their sites behave.

Where information differs between this site and one of those listings, ask us and we will tell you which is current.

Acceptable use

You may browse this site, and download or print pages for your own use in evaluating space at Smith Center. You may not:

• submit false, misleading or someone else's contact information;
• use the inquiry form to send advertising, solicitations, spam or bulk messages;
• scrape, harvest or systematically copy the site, its photographs or its listing data, including for training or re-publishing, without our written permission;
• attempt to break, overload, probe or gain unauthorised access to the site or the services behind it, including the form endpoint;
• copy the site's design, photographs or text to represent another property;
• use the site for anything unlawful, or in a way that interferes with anyone else's use of it.

We may block access, refuse to respond to inquiries or take other steps if we reasonably believe someone is doing any of the above.

Content on this site

The photographs, aerial images, floor plans, videos, written descriptions, the Smith Center name and mark, and the layout and design of this site belong to us or to the people who made them for us, and are protected by copyright and trademark law. Nothing here grants you a licence to use them beyond the personal use described above.

Brokers and listing services may reproduce listing information about currently available suites in the ordinary course of marketing them, provided it is not altered in a way that makes it misleading.

If you believe something on this site infringes your rights, tell us at fodmgmt@gmail.com and we will look into it.

Links and embedded content

This site links to and embeds material hosted elsewhere — walkthrough videos on YouTube, a location map from Google Maps, and listings on TenantCloud and LoopNet. Those services are run by other companies. We do not control them, we are not responsible for their content or availability, and a link is not an endorsement. Their terms and privacy practices apply when you interact with them.

Equal opportunity leasing

We lease on an equal opportunity basis and do not discriminate on the basis of race, colour, religion, sex, national origin, familial status, disability or any other class protected by federal, South Carolina or local law. If you need an accommodation to tour the property or to use this site, call or text us and we will work with you.

Disclaimers

The site and everything on it are provided “as is” and “as available.” To the fullest extent the law allows, we disclaim all warranties, express or implied, including any implied warranties of merchantability, fitness for a particular purpose, title and non-infringement.

We do not warrant that the site will be uninterrupted, error-free or secure, that defects will be corrected, or that the site or the servers that deliver it are free of harmful components. We do not warrant that the information on the site is complete, current or accurate, and we are not obliged to update it.

Statements about the property, the surrounding area, traffic counts, permitted uses or anything else on this site are general information gathered from sources we believe to be reliable, but we do not guarantee them.

Limitation of liability

To the fullest extent the law allows, we are not liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, lost business, lost opportunity or lost data, arising out of or relating to your use of this site — even if we have been told such damages are possible.

Our total liability for all claims relating to this site is limited to one hundred US dollars ($100). This limit applies to the website. It does not limit the rights or remedies of a tenant under a signed lease, and it does not exclude liability that cannot be excluded under South Carolina law.

Indemnification

You agree to indemnify and hold us harmless from claims, losses and reasonable legal costs arising out of your misuse of this site, your breach of these terms, or your violation of the law or of anyone else's rights in connection with the site.

Changes

We may change, suspend or discontinue any part of this site at any time, and we may revise these terms. The current version is always the one posted here, with the date at the top of the page. If you keep using the site after a change, you accept the revised terms. Changes are not retroactive and do not affect a dispute that arose before they were posted.

Governing law and where disputes are heard

These terms are governed by the laws of the State of South Carolina, without regard to its conflict-of-laws rules. Any dispute relating to this site will be brought in the state or federal courts serving Lexington County, South Carolina, and you and we each consent to those courts hearing it.

If any part of these terms is held unenforceable, the rest stays in effect.
